Parternity Leave
PATERNITY LEAVE – from April 2003 working fathers will have the legal right to two weeks’ paternity leave paid at a rate equivalent to the flat rate of SMP (which, from April 2003, will be £100 a week).

 
Paternity leave will be triggered by the onset of labour (not by a false start); and must be taken as a single block (Unless the employer agrees to something different); and must be taken within two month of childbirth.

 
As adoption leave has been approved for one of the adoptive parents; it follows that the remaining parent is eligible to parental leave, albeit different notification will need to be considered.

 
Recruiting Criminals
From Summer 2002 employers can request from prospective employees disclosure of any criminal records. Three levels are available, standard enhanced and basic.

 
In the main the information is seen to protect the young, elderly, disabled, etc. from the employment of people with history that would put them at risk.

 
However a basic disclosure can be requested by any employer as a general health / suitability check.

 
ECJ Ruling
All contracts of employment whether fixed, part time, full time, temporary or otherwise can no longer have a qualifying period before holiday entitlement can be accrued.

 
Employees now accrue holiday at a rate equal to one twelfth of their pro rata annual entitlement in advance. Should such calculation provide part days then this would be rounded up to the nearest half day.
